"Wrote Comment 'Two-Headed Man' on FB, Elementary School Teacher Jailed for 1 Month"

Jakarta - An elementary school teacher in Sukadana, Buleleng, Bali, Johan, had to languish in prison for 1 month. After being released by the Denpasar High Court (PT), Johan was again sentenced by the Supreme Court for writing insulting comments on FB.

The case began when Maria Goreti Delorita wrote a status on her Facebook wall on September 6, 2010. Then, a man whose full name is Herrybertus Johan Julius Calame wrote a comment on the Facebook wall by mentioning a third party, namely Antonius Sanjaya Kiabeni.

In his comments, Johan called Anton a 'two-headed man'. Feeling insulted, Anton then reported to the Buleleng Police on September 21, 2010. As proof that he was well-behaved and had never caused trouble, Anton asked for a driver from the Kampung Baru Subdistrict where he lived.

Due to the incident, Johan had to deal with the court. The public prosecutor (JPU) then demanded that Johan be sentenced to 2 months in prison for violating Article 45 paragraph 1 of Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE). On September 29, 2011, the Singaraja District Court (PN) granted and sentenced Johan to 1 month in prison.

The verdict was then annulled by the Denpasar High Court (PT) on January 13, 2012, acquitting Johan. The prosecutor appealed the verdict and it was granted.

"Declaring the defendant legally and convincingly proven guilty of committing a crime 'intentionally without the right to access electronic information containing insulting content'. Therefore sentencing the defendant to 1 month in prison," decided the cassation panel as reported on the MA website, Monday (6/10/2014).

Sitting as the chairman of the panel was Dr. Artidjo Alkostar with members Prof. Dr. Surya Jaya and Sri Murwahyuni. The three of them gave 5 reasons why Johan was sentenced to 1 month in prison. Among other things, Johan's comments were not intended to defend himself or defend the public interest. In addition, comments on FB are also not subject to press crimes because comments do not go through journalists or editors.

"To prove an insult, it is not required that the victim is a person who can be truly trusted. What must be proven is whether the victim feels insulted or ashamed, hurt or has his good name damaged or defamed," said the panel in the verdict that was delivered on September 12, 2013.

In terms of ideas, there is one main idea that triggers the development of the topic discussed, namely "two-headed humans." This is very abstract so that it gives rise to many perceptions, what is meant by a two-headed human in the case above? Is it really physically two-headed? Or is it just a figure of speech? This is still unclear where it is going, but what is certain is that if it has made other people feel insulted, then ethically it has violated, because it causes discomfort and is disturbing.

In my opinion, the actions taken by the victim were quite good, because they did not use violence, and chose the legal route, although it would have been better if it had been resolved through deliberation and consensus first, but it does not matter because everything has gone through the procedures set by the Republic of Indonesia as a cultural heritage after the old order.

The form of culture as a system of ideas is very abstract, cannot be touched or photographed and exists in the minds of individuals who adhere to the culture. The form of culture as a system of ideas can only be felt in everyday life which is manifested in the form of norms, customs, religion, and laws or statutes. As a system of ideas, what functions to regulate and become a reference for human behavior is social norms. Social norms are standardized unwritten and recognized together by members of the community group. For example, rules or norms of politeness in speaking to older people and rules for visiting other people's homes. The form of culture as a system of ideas is concretely found in laws or written regulations.

So from the case above, it can be concluded that Herrybertus Johan Julius Calame is guilty from the perspective of the cultural idea system because Herrybertus Johan Julius Calame has violated norms or manners by writing a comment on the Facebook wall calling Antonius Sanjaya Kiabeni a "two-headed man", where the comment can be accessed by many people and everyone can see it.
